司法改革方法论的反思性整合——一个实践理性的视角

在全面依法治国的时代背景下,司法改革的推进需要在实践理性的指导下,通过新的方法论体系来予以重新解读和把握。当下司法改革的方法论面临价值理性缺失、工具理性误区和理论范式失衡的现实困境,需要在问题导向的基础上,借鉴和利用多种社会科学方法,透过多种视角探讨如何认识改革、如何推进改革、如何评价改革,在实践建构中实现方法体系的反思性整合。以"制度化的社会回应型司法"为基本目标,协调价值理性与工具理性的冲突,统合国家治理的实践逻辑与法治的价值逻辑,统筹推进司法制度的改革和构建。     

Territorial reforms in Europe: effects on administrative performance and democratic participation

Territorial reform is the most radical and contested reorganisation of local government. A sound evaluation of the outcome of such reforms is hence an important step to ensure the legitimation of any decision on the subject. However, in our view the discourse on the subject appears to be one sided, focusing primarily on overall fiscal effects scrutinised by economists. The contribution of this paper is hence threefold: Firstly, we provide an overview off territorial reforms in Europe, with a special focus on Eastern Germany as a promising case for cross-country comparisons. Secondly, we provide an overview of the analytical classifications of these reforms and context factors to be considered in their evaluation. And thirdly, we analyse the literature on qualitative performance effects of these reforms. The results show that territorial reforms have a significant positive impact on functional performance, while the effects on participation and integration are indeed ambivalent. In doing so, we provide substantial arguments for a broader, more inclusive discussion on the success of territorial reforms.     

Accounting Reform in Italy and Perceptions on the Local Government Consolidated Report

The article aims to explore the perception of local government (LG) financial officers on the users, the uses, and the utility of the consolidated financial report in Italy, since it was one of the first countries to expressly provide for compulsory adoption. A questionnaire was sent to a statistical stratified sample of LG, collecting 133 responses (response rate 17%). The results, tested through the structural equation model we observe that social legitimization pressure rather than accountability patterns or performance analysis drive more the adoption process. The evidence indicates that the report is perceived as a potential tool for pursuing performance assessment strategies in a group context. However, this potentiality depends on the coordination effort made by the LG. The article finds out the rise of the topic of the public governance and the role of coordinating the local public group.     

统筹各类编制资源的改革方向和政策建议

统筹使用各类编制资源,是新时代机构和行政体制改革的重要方向。本文首先分析了编制分类的内容构成、不同类型编制的管理权限、编制总量控制的政策约束,进而对编制分类管理的效应及带来的问题进行了综合性分析。接着,追踪梳理当前地方统筹使用各类编制的最新探索和创新。在此基础上,从跨类别、跨部门、跨地域、跨层级四个维度,提出编制统筹管理改革的思路和政策建议。     

The Jenin Initiative: Counterinsurgency by Capacity Building

In late 2008, as negotiations between the Israelis and the Palestinians faltered, the US directed the Jenin Initiative on the ground in the West Bank. Designed to inspire confidence in Washington’s security-driven ‘West Bank First’ strategy, the Jenin Initiative married economic development to security sector reform under the Palestinian Authority. Drawing on the perspectives of those responsible for implementing the Jenin Initiative, this article reveals how counterinsurgency doctrine transplanted from the ‘war on terror’ shaped US interventions that built capacity in the Palestinian Authority. The Jenin Initiative exposes the extent of US intervention to create an effective apparatus of Palestinian self-policing to enhance – but not replace – that of the Israeli occupation.     

高校治理体系和治理能力现代化视域下教代会改革创新 ：理论逻辑与实践指向

从党的十八届三中全会到十九届四中全会,国家治理体系和治理能力现代化从理论内涵到实践路径不断得以明确,为高校治理体系和治理能力现代化指明了方向、提出了要求。民主治理是新时期高校治理现代化的重要方面之一,因此,教代会工作的改革创新也就成为了这一目标下的必然要求。本研究在论证教代会改革创新的理论逻辑必然性的基础上,通过重新审视高校教代会的工作现状和改革创新面临的困境,探讨了加强党对教代会工作的全面领导、完善教代会改革创新的运行和保障机制,以及夯实教代会民主治校工作中源头参与的实效举措这三方面的治理实践指向。     

数字经济监管体制创新的导向与路径

数字经济发展要求对传统监管体制进行重构,通过监管体制创新来促进数字经济高质量发展。数字经济监管体制创新的基本导向为:始终坚持审慎包容的基本原则,将促进开放共享和鼓励创新作为政策基点、维护市场竞争作为政策重心、确保监管体制与政策动态有效作为政策理念。中国数字经济监管体制创新的基本路径为:建立相对完善的监管法律体系,构建"平台+政府"双中心协同监管的治理主体结构,形成与数字经济相适应的监管机构体制,实现审慎包容监管原则制度化,创新监管实施体制和政策手段。     

Cohabitation,female sacrifice,and judge-made law

This paper shares results of a study of judgments applying the common law as adapted to the cohabitation context. Specifically, the Supreme Court of Canada has held that couples who formed a ‘joint family venture’ may need to share the wealth gained during cohabitation. The study compares the couples leading to positive and negative findings of a joint family venture. Positive findings correlate with traditional markers of family and economic integration, such as joint bank accounts and the presence of children. Despite the discourse of family diversity, gendered patterns run across all the couples, with women assuming primary care of children, shouldering domestic labour, and making career sacrifices for the family. In a sign of the limits of judge-made reforms, the doctrine may be harder for some claimants to access than for others, in ways not necessarily tracking commitment and economic integration.
